It is understood Ken Gehring Photography is the exclusive official photographer retained to perform the photographic services requested on the contract.

If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting to the artistic standards of Ken Gehring Photography, photographer may elect to use an alternate location or to reschedule the portrait.

No part of any order, will be delivered until the balance is paid in full.

By default Ken Gehring Photography reserves the right to use images created under this contract for advertising, display and publication. The client signing contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend Ken Gehring Photography in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of Ken Gehring Photography.

In the event Ken Gehring Photography is not able to provide services on your scheduled date and time due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness or emergency, your session will be rescheduled or your session fees refunded. This would only be if absolutely necessary and is not expected to be a possibility.

If Ken Gehring Photography cannot perform this contract due to fire or other casualty, strike, act of God or other cause beyond the control of the parties, or due to the Photographer’s illness or emergency, and the sitting fee is refunded to the client, Ken Gehring Photography shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event Ken Gehring Photography fails to perform for any other reason, Ken Gehring Photography shall not be liable for any amount in excess of all monies paid.

Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and client releases Ken Gehring Photography from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

The charges in the contract are based on Ken Gehring Photography’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

  • Ken Gehring Photography processes Personal Data both as a Processor and as a Controlleras defined in the Directive and the GDPR.

  • The Ken Gehring Photography entity which you as a User entered an agreement with when using Ken Gehring Photography’ platform will be the controller for User data.

  • Ken Gehring Photography collects personal information when you register for updates or when you purchase Ken Gehring Photography products or services.

  • When you register for updates, we collect information such as your name and email address and any other information you choose to provide.

  • When you purchase products or services, we collect additional information needed to complete the transaction such as your shipping address, telephone number, and other billing information.

All credit card transactions carried out in connection with purchases from classicphotographers.com are transacted via third parties using secure servers. No financial details are retained on our server and the third parties only confirm to us that payment has been received and the name, email address and shipping address of the purchaser. The third parties do not communicate credit card or any other details to us and have their own, strict, privacy policies in place.
